Property issues

Property issues are inevitably linked to both divorce and separation as your home can often be (along with your pension) one of the most significant assets that you own. Additionally where you are all going to live is a question that most people want ot resolve as soon as possible It is important that at an early stage we identify who owns the property, on what basis, who lives in the property and whether it is going to be possible for the property to be retained.

From a divorce perspective, if you look at our fact sheet called "What Orders can the Court make" you will see that the Court has the power to make various Orders in relation to property either on a contested basis or by agreement between the parties. We may need to explore your respective borrowing capacity and look at all the options available to you in conjunction with your other assets and liabilities.
